Oura Ring 5 Giveaway Terms and Conditions

1. The Promoter
This promotion is conducted by Enhancd Performance Pty Ltd (ACN 684 890 168) trading as Enhancd Performance, ABN 18 684 890 168, of Level 1, 241 Adelaide Street, Brisbane City, Queensland 4000, Australia (the "Promoter"). Questions about this promotion can be directed to support@enhancdperformance.com.
2. Promotion period and draw periods
This is an ongoing promotion conducted in quarterly draw periods. Each draw period runs for one calendar quarter: 1 January to 31 March, 1 April to 30 June, 1 July to 30 September, and 1 October to 31 December, each closing at 11:59pm Australian Eastern Standard Time on the last day of that quarter (each a "Draw Period"). Entries earned during a Draw Period go into the draw for that Draw Period only and do not carry over. The promotion continues until the Promoter gives notice on this page that it has closed. The Promoter's server clock is the official timekeeping device for this promotion.
3. Eligibility
Entry is open to residents of Australia and New Zealand aged 18 years or over at the time of entry who have made a qualifying purchase (see clause 4). Employees, contractors and immediate family members of the Promoter, and of any agencies associated with this promotion, are not eligible to enter. The Promoter may require entrants to provide proof of identity, age, residency and eligibility to its reasonable satisfaction. The Promoter may verify the validity of entries and reserves the right to disqualify any entrant who tampers with the entry process, submits an entry that is not in accordance with these terms, or engages in conduct that is fraudulent or damaging to the fair conduct of the promotion.
4. How to enter
Entry is automatic for eligible customers and no separate registration is required. Each qualifying order of Enhancd Sleep Gummies placed and paid for during a Draw Period earns one (1) entry into the draw for that Draw Period. Each subscription renewal order that is placed and paid for during a Draw Period also earns one (1) entry into the draw for that Draw Period. There is no limit on the number of entries an eligible customer can earn through separate qualifying orders. Orders that are cancelled, refunded or charged back before the draw are not eligible and any entries earned from them are void.
5. The prize
There is one (1) prize available to be won in each Draw Period, consisting of:
- one (1) Oura Ring 5 in the winner's choice of available size and finish, valued at up to A$799.00 recommended retail price; and
- twelve (12) months of Oura membership, valued at A$109.99.
The total prize pool for each Draw Period is A$908.99. Prize values are correct at 11 August 2026 and the Promoter accepts no responsibility for any variation in prize value after that date. The membership component is provided as a twelve (12) month membership commencing when the winner activates their ring. Any Oura membership fees payable after that twelve (12) month period are the winner's responsibility.
Ring sizing will be determined using Oura's standard sizing process before the ring is ordered. The winner must provide their finish preference and complete sizing within a reasonable period when asked, so that the prize can be supplied.
The prize is not transferable, not exchangeable and cannot be redeemed for cash. If any part of the prize becomes unavailable for reasons beyond the Promoter's control, the Promoter reserves the right to substitute a prize of equal or greater value, subject to any written directions from the relevant regulator.
6. The draw
The winner for each Draw Period will be determined by a random draw conducted at Level 1, 241 Adelaide Street, Brisbane City, Queensland 4000, Australia at 10:00am Australian Eastern Standard Time on the fifth business day following the end of that Draw Period. The draw is a game of chance and no skill is involved. Every valid entry has an equal chance of being drawn. Two (2) reserve entries will be drawn in order in case a winning entry is deemed invalid or a prize is unclaimed under clause 8.
7. Winner notification
The winner will be notified by email and/or telephone using the contact details associated with their qualifying order within two (2) business days of the draw. The winner's first name and initial of surname, and state, territory or region of residence, will be published on this page from the date of notification for a period of not less than 28 days.
8. Claiming the prize and unclaimed prizes
To claim the prize the winner must respond and provide a valid Australian or New Zealand delivery address within fourteen (14) days of being notified. If a winner cannot be contacted, does not respond within the claim period, is found to be ineligible, or does not comply with these terms, the winner forfeits the prize and the Promoter reserves the right, subject to any applicable regulator directions, to conduct an unclaimed prize draw at the address in clause 6 at 10:00am Australian Eastern Standard Time on the twenty-first (21st) day after the claim period expires. Any unclaimed prize winner will be notified and published in the same manner as set out above.
9. Prize delivery
The prize will be delivered to the winner's nominated Australian or New Zealand address at no cost to the winner within a reasonable period after the prize is claimed and sizing is confirmed. The Promoter is not responsible for prizes lost, delayed or damaged in transit once dispatched, except to the extent required by law.
10. Independence from Oura
This promotion is in no way sponsored, endorsed, administered by or associated with Oura Health Oy, Ouraring Inc. or their related entities. "Oura" and "Oura Ring" are trademarks of their respective owners. All enquiries relating to this promotion must be directed to the Promoter and not to Oura.
11. Limitation of liability
Nothing in these terms excludes, restricts or modifies any rights or remedies a consumer may have under the Australian Consumer Law, or, for New Zealand entrants, under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, or any other law that cannot lawfully be excluded. Subject to that, the Promoter, to the extent permitted by law, is not liable for any loss, damage, cost or expense (including indirect or consequential loss) suffered or incurred in connection with this promotion or the prize, including any loss arising from any act, omission, delay, event or failure beyond the Promoter's reasonable control. The Promoter is not responsible for any lost, late, incomplete, misdirected or corrupted entries or communications.
12. Privacy
The Promoter collects entrants' personal information to conduct this promotion, including to verify eligibility, notify and publish winners, and deliver the prize. The Promoter handles personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles, and, for New Zealand entrants, the Privacy Act 2020 (NZ), and in accordance with the Enhancd Privacy Policy at https://enhancdperformance.com/policies/privacy-policy. Personal information may be disclosed to third parties assisting with the promotion, to regulators and as otherwise permitted by law. Entrants can request access to or correction of their personal information by contacting the Promoter at the address in clause 1.
13. General
By entering, entrants accept these terms and conditions. The Promoter's decisions on all matters relating to the promotion are final and no correspondence will be entered into. If this promotion cannot run as planned for reasons outside the Promoter's reasonable control, the Promoter reserves the right, subject to any applicable law and regulator direction, to cancel, terminate, modify or suspend the promotion. Failure by the Promoter to enforce any of its rights does not constitute a waiver of those rights.
14. Permits and authorities
The prize pool for each Draw Period is A$908.99. On the thresholds current at the date of this page, that is below the Australian Capital Territory trade promotion permit threshold and below the South Australian trade promotion lottery licence threshold, and below the New Zealand licensing threshold for sales promotion schemes under the Gambling Act 2003 (NZ). Permit and licensing requirements differ by state, territory and country and change over time. The Promoter will confirm the current requirements for each jurisdiction it promotes into and obtain any required permit before relying on this clause.
15. Governing law
This promotion and these terms are governed by the laws of Queensland, Australia, and entrants submit to the non-exclusive jurisdiction of the courts of that state. Nothing in this clause limits any non-excludable rights a New Zealand entrant has under New Zealand law.
